When a DOT drug or alcohol violation occurs, federal law requires you to complete the Return-to-Duty (RTD) process with a qualified Substance Abuse Professional (SAP) before resuming any safety-sensitive duties. IBH makes this process simple, fast, and fully compliant with 49 CFR Part 40.
Step 1 — Initial DOT-SAP Assessment
Once you receive a DOT violation—such as a positive drug or alcohol test, refusal to test, or another prohibited action—you must immediately stop performing safety-sensitive duties, as required by DOT regulations.

B. Substance Use Treatment Program
Levels of care vary depending on the clinical assessment and may include:
Outpatient counseling

Step 3 — Follow-Up SAP Appointment & Return-to-Duty Authorization

Determine whether you are ready to return to safety-sensitive work
Issue your Return-to-Duty Report/Letter

Your Return-to-Duty documentation is sent directly to your employer, as required.

Certain Maryland CDL holders may also need to visit the Maryland MVA to complete reinstatement procedures after the SAP process is finished.
Step 4 — Follow-Up Testing Requirements
Even after returning to work, DOT regulations require ongoing follow-up testing to ensure continued compliance. Your SAP will create a customized, federally mandated follow-up testing schedule, which includes:
At least six (6) unannounced drug/alcohol tests in the first 12 months
Additional testing that may continue for up to five (5) years (60 months)
Tests conducted separately from normal random testing pools
Your employer is responsible for carrying out the testing schedule exactly as prescribed.
